Terms of Service
Effective date: June 16, 2026
1. Agreement
By downloading or using Tend ("the App"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the App. These Terms form a binding agreement between you and PerfectCity Corp ("we", "us", "our").
2. License
We grant you a personal, non-transferable, non-exclusive license to use Tend on devices you own or control. You may not copy, modify, reverse-engineer, or redistribute the App.
3. Your Account
You sign in using Sign In with Apple. You're responsible for keeping your device secure and for all activity under your account. Notify us immediately at hello@perfectcity.com if you believe your account has been compromised.
4. Subscriptions and Free Trial
- Tend offers a 14-day free trial followed by an auto-renewing subscription.
- Subscriptions are billed through the Apple App Store. Apple's standard subscription terms and cancellation policies apply.
- You can manage or cancel your subscription at any time via Settings → Apple ID → Subscriptions on your iPhone.
- No refunds are provided for partial subscription periods except as required by law or Apple's policies.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Upload content that is illegal, harmful, or infringes third-party rights.
- Reverse-engineer or extract source code from the App.
- Use the App to compete with us in the same product category without our written consent.
6. AI-Generated Content
Tend uses AI to generate maintenance recommendations, seasonal care plans, and data extracted from photos. AI output may contain errors. You are responsible for verifying any maintenance decisions. We are not liable for errors in AI-generated suggestions.
7. User Content
You own the data you enter into Tend (property details, maintenance records, photos, etc.). By using the App, you grant us a limited license to store and process your data solely to provide the service. You can delete your account and all associated data at any time from the Settings screen.
8. Third-Party Services
Tend integrates with third-party services (Apple, Stripe, Google, Cloudflare, Anthropic, NHTSA, CPSC). Your use of those services is subject to their own terms and policies. We are not responsible for the accuracy of data from third-party sources such as VIN data or recall databases.
9. Household Sharing
Household Sharing lets multiple users share access to your assets. You are responsible for who you invite. Members you add can view and, depending on permissions, modify your shared data. Remove members at any time from Settings.
10. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERFECTCITY CORP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless PerfectCity Corp and its affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
13. Changes to Terms
We may update these Terms. Continued use of the App after changes take effect constitutes acceptance. We'll notify you in-app for material changes.
14. Termination
We may suspend or terminate your access if you violate these Terms. You may terminate by deleting your account and uninstalling the App.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Santa Clara County, California.
